Acceptable Use Policy (AUP)

This policy is included in our Terms of Service (Related Policies).

This Acceptable Use Policy ("AUP") defines the standards for the use of services provided by BelgiumVM ("belgiumvm.be", "we," "us," or "our"), operating as the sole proprietorship (eenmanszaak) Leemans, Niels, registered in Belgium.

By accessing or using our services, you agree to comply with this policy, which is formally incorporated by reference into our Terms of Service (ToS). We reserve the right to update this policy at any time to reflect the evolving nature of our services, legal requirements, and cybersecurity threats.

1. Scope and Applicability

This AUP applies to all services offered by BelgiumVM, including but not limited to Virtual Private Servers (VPS), dedicated servers (bare metal), network resources, and administrative control panels. This policy applies to all account holders, employees, contractors, and any third-party users granted access to our services by a primary account holder.

2. Permitted and Prohibited Use

2.1 Permitted Use

You are permitted to use BelgiumVM services for any lawful purpose that does not interfere with the functionality, security, or stability of our infrastructure or the experience of other customers.

2.2 Prohibited Use

You shall not use, or permit the use of, BelgiumVM services for any of the following:

  • Illegal Content: Hosting, distributing, or promoting content that is illegal under Belgian law, European Union law, or applicable international law. This includes, but is not limited to, Child Sexual Abuse Material (CSAM), non-consensual sexual content, terrorism, hate speech, or incitement to violence.
  • Malicious Activity: Engaging in cyberattacks, including DDoS attacks, port scanning, unauthorized vulnerability scanning, exploitation of software flaws, or attempting to compromise any system (ours or others).
  • Phishing and Fraud: Hosting sites or services intended to deceive, defraud, or impersonate entities to harvest sensitive information (e.g., credentials, financial data).
  • Distribution of Malware: Hosting, distributing, or enabling the spread of viruses, worms, Trojan horses, ransomware, or any other malicious code.
  • Unsolicited Communication (Spam): Sending, distributing, or enabling the transmission of unsolicited commercial email (spam) or bulk messaging.
  • Unauthorized Resource Usage: Mining cryptocurrency, running resource-intensive scripts that destabilize the physical node/host, or engaging in "shady" activities that attract inbound DDoS attacks that affect other customers.

3. Compliance with Laws and Sanctions

  • Legality: You agree that your use of the services is in full compliance with all applicable local, national, and international laws, including GDPR (General Data Protection Regulation) regarding data handling.
  • Sanctions: You warrant that you are not on any government prohibited or restricted person lists. You shall not use our services if you are located in a country subject to comprehensive international trade sanctions or embargoes.

4. Platform Security and Misuse

  • Integrity: You are responsible for the security of your Virtual Machine or server instance. You must maintain current patches, secure passwords, and appropriate firewall configurations.
  • Responsibility for Misuse: BelgiumVM is not liable for data loss or security breaches caused by your failure to secure your instance. If your server is compromised and used for malicious activity, you remain responsible for that activity.

5. Third-Party and Sub-User Responsibility

If you are a reseller or provide access to our services to third parties (sub-users):

  • You are fully responsible for the actions of your sub-users.
  • You must ensure that your own AUP or contractual agreements with your sub-users are at least as restrictive as this policy.
  • You agree to cooperate fully with BelgiumVM in the event of an investigation into the conduct of your sub-users.

6. Monitoring and Enforcement

6.1 Monitoring

BelgiumVM reserves the right, but assumes no obligation, to monitor network traffic and server activity to ensure compliance with this AUP. This includes, but is not limited to, automated scanning for vulnerabilities, malicious patterns, or bandwidth abuse.

6.2 Enforcement Actions

In the event of a violation of this AUP, BelgiumVM reserves the right to take the following actions, at our sole discretion, without prior notice:

  • Warning: Issuing a formal warning regarding the prohibited activity.
  • Suspension: Temporarily disabling access to the server, service, or account while an investigation is conducted.
  • Restricted Access for Remediation (Discretionary): In circumstances where intentional violation is unclear, BelgiumVM may, at its sole discretion, provide temporary, restricted access to the affected service. This access is granted strictly for the purpose of backing up necessary data prior to a mandatory service reset. This courtesy is entirely optional on our part and serves as a final warning before permanent termination.
  • Termination: Permanently terminating the account and services, including the deletion of all data associated with the account.
  • Legal Action: Reporting activities to law enforcement agencies where required by law.

7. Reporting Violations

If you become aware of any violation of this policy by a BelgiumVM user, please report it immediately to our abuse department at abuse@belgiumvm.be.
